§ 1-7.03. Expedited judicial review.

  • Pursuant to California Code of Civil Procedure Section 1094.8(c), and any successor statute or regulation, the following permits, licenses, conditions, entitlements, and decisions of this Code are designated for expedited judicial review pursuant to the procedure set forth in California Code of Civil Procedure Section 1094.8, or any successor statute or regulation:

    (a)

    Permits issued pursuant to Chapter 32 of Title 5;

    (b)

    Denial or conditioning of a permit to the dissatisfaction of an applicant pursuant to Section 5-17.06(b)(3) of Chapter 17 of Title 5;

    (c)

    Licenses for subdivision directional signs issued pursuant to Article 9 of Chapter 1 of Title 7;

    (d)

    Decisions regarding sexually oriented business pursuant to Chapter 8 of Title 5 and Section 9-1.807(2)(e);

    (e)

    Decisions regarding signs regulated by Article 10 of Chapter 1 of Title 9;

    (f)

    Decision regarding denial of a permit for a newsrack or an adverse decision after a hearing pursuant to Article 10 of Chapter 1 of Article 7;

    (g)

    Decisions refusing to issue or revoking a permit pursuant to Chapter 12 of Title 5; and

    (h)

    Any other provision of this Code designated by City Council ordinance or resolution as being subject to expedited judicial review.
