§ 2-3.207. Functions.

  • The functions of the Citizens' Election Advisory Commission shall be as follows:

    (a)

    To provide Council and Mayoral candidates and municipal ballot measure proponents and opponents with copies of State and City election regulations, the City's political campaign sign regulations, and campaign guidelines adopted by the Council;

    (b)

    To review financial campaign statement forms (receipts and expenditures) submitted to the City Clerk and inform candidates or ballot measure proponents and opponents of any missing, unclear, or incomplete campaign statements;

    (c)

    To recommend to the City Clerk appropriate forms and information to be included in the packet which shall be given to Council and Mayoral candidates and ballot measure proponents and opponents at the time of taking out or filing papers with the City Clerk;

    (d)

    To work with the City Manager or his designee in the preparation and presentation of one or more orientation briefings to be given to all candidates and ballot measure proponents and opponents on those matters set forth in subsection (a) of this section, as well as the use of all required campaign forms and, as appropriate, information relative to the operation of the City;

    (e)

    To inform the appropriate legal authorities for determination and action thereon of any instance in which a candidate or ballot measure proponent or opponent has failed, after due notice and within a reasonable time, to correct, clarify, or complete a financial campaign statement;

    (f)

    To conduct informal advisory hearings to assist municipal candidates and municipal ballot measure proponents and opponents in the resolution of disputes which may arise during the conduct of the campaign. Such dispute resolution assistance shall be purely voluntary as to the parties involved and shall involve a minimum of City staff time. The decision, if any, of the Commission shall be advisory and non-binding on the parties involved and shall be final and not subject to appeal to the Council; and

    (g)

    To facilitate, whenever possible, communications between municipal candidates and municipal ballot measure proponents and opponents with the appropriate State and local agencies, boards, or commissions regarding election campaign questions or issues.
