§ 5-34.01. Police emergency response civil cost recovery.

  • (a)

    Whenever the Simi Valley Police Department dispatches a police officer to an emergency response to the same residential address or location on more than five (5) occasions during a consecutive 365 calendar day period or to the same commercial or industrial address or location on twelve (12) or more occasions during a consecutive 365 day calendar period, the owner of the property and/or the occupants or tenants of the property shall be jointly and severally liable for the actual cost of responding for any emergency response(s) in excess of the applicable occasions during the consecutive 365-day period. Response to false alarms or disturbing parties is not included in totaling response(s) under this section.

    (b)

    An owner, occupant or tenant shall not be liable for billed costs under this section if that person was not the owner, occupant or tenant, respectively, of the property, during the time period within which the billed emergency responses occurred.
