§ 5-34.03. Miscellaneous provisions.

  • (a)

    The actual cost of response shall be determined by the City Council approved Schedule of Services Charges in existence at the time of the sixth or subsequent emergency response in a residential area or twelfth or subsequent emergency response in a commercial or industrial area, as applicable, in Section 5-34.01 or on each response pursuant to Section 5-34.02.

    (b)

    A police "emergency response" is defined as the arrival of uniformed police officer(s) at an address pursuant to a request for police assistance regarding an in progress disturbance involving a possible crime against person or property.

    (c)

    An owner, occupant or tenant of the property who is the victim of a crime shall not be liable for emergency cost response for any emergency response directly related to that crime.

    (d)

    Any violation of this chapter is a civil, and not criminal, violation and is in addition to any other remedy provided by law.
