Article 2. Prohibition of Non-Stormwater Discharges |
§ 6-12.201. Discharge Prohibitions.
No Person will Discharge any substance to the City Storm Drain System except as stated in Part 1-Discharge Prohibitions of the City's Municipal Separate Storm Sewer System, National Pollutant Discharge Elimination System Permit No. CAS004002 and as listed below:
(a)
Discharges that are in compliance with a Discharge Permit;
(b)
Discharges that originate from a Federal, State, or other source from which the City is pre-empted from regulating by State or Federal law;
(c)
Discharges that are covered by a separate individual or general NPDES Permit, or conditional waiver for irrigated lands;
(d)
Discharges that arise from fire fighting activities;
(e)
Discharges that are from the following Natural Flows:
(1) Stream diversions authorized by the State Water Quality Control Board or by the Regional Board;
(2) Natural springs and rising groundwater;
(3) Uncontaminated groundwater infiltration as defined by 40 CFR 35.2005 (20); or
(4) Flows from riparian habitats or wetlands, provided all necessary permits or authorizations are received prior to diverting the stream flow.
(f)
Discharges from potable water sources that meet all of the following criteria:
(1) Flows that are low volume, incidental, and infrequent releases that are innocuous from a water quality perspective;
(2) Flows that are de-chlorinated, pH adjusted, re-oxygenated, and both the volume and velocity are controlled to prevent suspension of sediments; and
(3) Flows in which all of the sediments are collected and disposed of in compliance with the Clean Water Act, 33 U.S.C. § 1251 et. seq., the Porter-Cologne Water Quality Control Act, California Water Code § 13000 et. seq., the Resource Conservation and Recovery Act, 42 U.S.C. § 6901 et. seq.
(g)
Discharges from gravity flow from foundation, footing, or crawl space drains;
(h)
Discharges from air conditioning condensate with flow segregated to prevent introduction of Pollutants;
(i)
Landscape irrigation discharges composed of either reclaimed or potable water;
(j)
Discharges that are dechlorinated/debrominated swimming pool Discharges that meet all of the following conditions:
(1) Chlorine or bromine residual that does not exceed 0.1 mg/L;
(2) Does not contain any chemicals, detergents, wastes, or algaecides;
(3) Does not contain cyanuric acid in excess of 50 mg/L;
(4) Does not contain salts in excess of Water Quality Standards as defined in the Basin Plan;
(5) PH must be between 6.5 units and 8.5 units; and
(6) The volume and velocity are controlled so as to prevent re-suspension of sediments.
(k)
Discharges from non-commercial car washing by residents or non-profit organizations.
(l)
Discharges from sidewalk rinsing that meet all of the following conditions:
(1) A high pressure-low volume water device with no additives is used which does not include the use of a garden hose with a pressure nozzle;
(2) There is an average usage of 0.006 gallons of water per square foot of surface area; and
(3) Waste generated from the activity is collected and properly disposed of in accordance with the Clean Water Act, 33 U.S.C. § 1251 et. seq., the Porter-Cologne Water Quality Control Act, California Water Code § 13000 et. seq., the Resource Conservation and Recovery Act, 42 U.S.C. § 6901 et. seq.
(m)
Pooled Stormwater Discharges from Treatment BMPs that meet all of the following conditions:
(1) The Discharge is not a source of Pollutants; and
(2) The sediments have been disposed of in compliance with the Clean Water Act, 33 U.S.C. § 1251 et. seq., the Porter-Cologne Water Quality Control Act, California Water Code § 13000 et. seq., the Resource Conservation and Recovery Act, 42 U.S.C. § 6901 et. seq.
(n)
Discharges from flows incidental to urban activities that meet any of the following conditions:
(1) A separate NPDES Permit has been obtained for Groundwater dewatering;
(2) A separate NPDES Permit has been obtained for Discharges from foundation, footing, and crawl drains dewatering; or
(3) A separate NPDES Permit has been obtained for water from crawl space pumps.
