Article 5. Requirements for the Control of Urban Runoff |
§ 6-12.501. Stormwater Pollution Control Plans.
(a)
General Requirements. Any Responsible Party who:
(1) Engages in Construction Activities that requires a grading permit;
(2) Is subject to any State general or individual Stormwater permit;
(3) Engages in activity that contributes Pollutants to Stormwater, or to the Storm Drain System; or
(4) Engages in industrial, commercial, and institutional activity for which BMPs have been established, must comply with the following:
(A) All conditions and requirements established by the Clean Water Act which are related to the reduction or elimination of Pollutants in Stormwater from the construction site or facility;
(B) All conditions and requirements established by the City to protect specific Watersheds or drainage basins as contained in the City's ordinances and written policies related to Planning, Building and Safety, and Development;
(C) Provide an approved SWPPP if required by the state;
(D) Provide an SWPCP, which must:
(1) Identify the Responsible Party;
(2) Identify the site location/address and provide phone number(s);
(3) Identify the potential Pollutant sources;
(4) Describe the design, placement, and implementation of BMPs which must prevent Non-Stormwater Discharges and reduce Pollutants in Stormwater Discharges to the Storm Drain System to the Maximum Extent Practicable;
(5) Comply with the conditions and requirements of this chapter.
(E) Amend the SWPCP whenever there is a change in construction or operations which may affect the Discharge of Pollutants to surface waters, groundwaters, or the Storm Drain System; and
(F) Retain a copy of the approved SWPCP on site at all times to be made available to any authorized inspector or Regional Board representative.
(b)
The State SWPPP may be accepted as a City required SWPCP, if it is determined by the Director that it meets the City's SWPCP guidelines.
(c)
The Director may require additional conditions or BMPs to be included with a SWPPP or require the submission of a separate SWPCP or Local SWPPP if the SWPPP is inconsistent with the City's SWPCP guidelines.
(d)
Specific Requirements for Construction Activities on Sites that are One Acre or Greater.
(1) The Responsible Party conducting Construction Activities on sites that are one acre or greater in size must submit to the Director the following:
(A) A local SWPPP that contains the appropriate site-specific construction site BMPs with the specific site locations identified and maintenance schedules;
(B) A local SWPPP which specifies the rationale used to select or reject BMPs for the various construction phases and weather conditions; and
(C) A signed statement by the project architect, engineer of record, or authorized qualified designee, of the Local SWPPP stating the following:
"As the architect/engineer of record, I have selected appropriate BMPs to effectively minimize the negative impacts of this project's construction activities on storm water quality. The project Owner and contractor are aware that the selected BMPs must be installed, monitored, and maintained to ensure their effectiveness. The BMPs not selected for implementation are redundant or deemed not applicable to the proposed construction activity."
(2) Each Owner or the Owner's agent must sign and submit a certification on the Local SWPPP stating the following:
"I certify that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to ensure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system or those persons directly responsible for gathering the information, to the best of my knowledge and belief, the information submitted is true, accurate, and complete. I am aware that submitting false and/or inaccurate information, failing to update the Local SWPPP to reflect current conditions, or failing to properly and/or adequately implement the Local SWPPP may result in revocation of grading and/or other permits or other sanctions provided by law."
(e)
Specific Requirements for Industrial, Commercial, and Institutional Activities.
(1) A Responsible Party must submit a SWPCP to and obtain the approval of the Director for the SWPCP pursuant to the City's SWPCP guidelines within thirty (30) calendar days of receiving notice to prepare a SWPCP.
(2) A Responsible Party conditioned to submit a SWPCP must submit a SWPCP to and obtain the approval of the Director in compliance with the City's SWPCP guidelines, before a certificate of occupancy is issued.
(3) A Responsible Party whose Industrial Activity is subject to a State NPDES permit must submit a copy of the Notice of Intent, SWPPP, monitoring plan, if required, and the letter of authorization from the Regional Board to the Director at least ten (10) days prior to conducting regulated activity at the facility or site.
