§ 6-12.601. Inspections Warrants and Monitoring.
(a)
Inspection Warrant. Whenever it is necessary to make an inspection to monitor or enforce any of the provisions of, or perform any duty imposed by, this chapter or other applicable law, or whenever the Director has reasonable cause to believe there exists upon any premises any violation of the provisions of this chapter or other applicable law, or any condition which makes such premises or mobile and portable equipment, hazardous, unsafe or dangerous, the Director may obtain an Inspection Warrant, as established in California Code of Civil Procedure Section 1822.50 through Section 1822.60, unless consent from the Responsible Party has otherwise been obtained.
(b)
Monitoring.
(1) The Director may undertake monitoring and analysis of both the construction and maintenance of devices or require the Responsible Party of the property to undertake construction and maintenance of devices, at the Owner's expense, when specified in a Discharge permit, order, or SWPCP/SWPPP.
(2) A Discharge permit, order, or SWPCP/SWPPP requiring construction and maintenance of such devices will specify a schedule for completion and any requirements for maintenance and monitoring.
(c)
Test Results.
(1) The Responsible Party for the property subject to monitoring will provide copies upon demand to the Director of all test results required as a part of a monitoring plan by the State or Regional Board or as required under a State or City Discharge permit, order, or SWPCP/SWPPP
(2) The Responsible Party for the property must submit a written request to the Director to receive a copy of test results conducted by the Director.
(d)
Critical Source Monitoring.
(1) Critical Source facilities will be inspected to verify that the facility is implementing the BMPs pursuant to the Municipal Separate Storm Sewer System, National Pollutant Discharge Elimination System Permit No. CAS004002 or the State General Industrial Permit.
(2) Where Stormwater flows from the facility to an Environmentally Sensitive Area the Director may require implementation of additional BMPs pursuant to the Municipal Separate Storm Sewer System, National Pollutant Discharge Elimination System Permit No. CAS004002 or the State General Industrial Permit.
(e)
Industrial Facility Monitoring. The Director may monitor facilities categorized as Industrial facilities to confirm the facility:
(A) Has a current Waste Discharge Identification Number;
(B) Has a SWPPP available on-site;
(C) Is effectively implementing BMPs in compliance with the Municipal Separate Storm Sewer System, National Pollutant Discharge Elimination System Permit No. CAS004002, State General Industrial Permit, or this chapter.
(D) Has a current No Exposure Certification, if necessary.
