§ 7-1.806. Lawns and ground covers: Use by public.

  • The public may not be denied the use of the planted area within public rights-of-way for pedestrian or other lawful uses. The City may use such planted areas for any purpose and may issue a permit to any applicant to perform encroachment work pursuant to the provisions of this chapter and Chapter 3 of this title. If the lawn or similar ground cover is damaged in the course of an authorized encroachment, the permittee who caused the damage shall be responsible for the replacement of such lawn or ground cover, unless the permit specifically states otherwise.
